Thank you for choosing Overland Underwater. We are committed to delivering safe, supportive, and inspiring underwater experiences. These Terms & Conditions outline the responsibilities, expectations, and protections for both you and our team. By booking, attending, or participating in any Overland Underwater activity, you agree to the following terms.
1. Definitions
“We”, “Us”, “Our” refers to Overland Underwater.
“You”, “Your” refers to the participant, customer, or parent/guardian of a participant.
“Services” refers to all training, courses, pool sessions, experiences, events, and activities delivered by Overland Underwater.
2. General Terms of Use
2.1 By booking or participating in any service, you confirm that you have read, understood, and agree to these Terms & Conditions and our Privacy Policy.
2.2 We may update these Terms at any time. The version published on our website at the time of booking applies to your purchase.
2.3 We reserve the right to modify, suspend, or withdraw any service where necessary for safety, operational, or regulatory reasons.
3. Eligibility & Prerequisites
3.1 You are responsible for ensuring you meet all prerequisites for your chosen activity, including:

Required certifications

Medical fitness to dive

Completion of all mandatory documentation
3.2 You must provide accurate and complete information at all times.
3.3 If you are unsure whether you meet the prerequisites, please contact us before booking.
4. Mandatory Documentation & Medical Requirements
4.1 All divers must complete the required SSI/PADI/RSTC documentation before participating. This includes:

Medical Questionnaire

Liability Release
-
Safe Diving Practices Statement
4.2 If you answer “yes” to any medical question, you must obtain written clearance from a physician before participating.
4.3 Failure to provide required documentation or medical clearance will result in the session being cancelled and treated as a late cancellation.
5. Payments, Cooling‑Off Period & Refunds
5.1 Payment is required in accordance with the terms displayed at the time of booking.
5.2 Cooling‑Off Period
You have a 14‑day cooling‑off period from the date of purchase.
If you cancel within this period:

A refund will be issued minus an administrative and processing fee.

If digital training materials have already been allocated, their cost will also be deducted.
5.3 After the cooling‑off period, no refunds will be issued for any reason, including but not limited to:

Change of mind
-
Scheduling difficulties
-
Medical issues arising after purchase
-
Failure to complete required documentation
-
Inability to attend booked sessions
5.4 Course Completion Window
All courses must be completed within 1 year of purchase.
After this period, all unused training, sessions, and materials expire and cannot be refunded, transferred, or credited.
6. Cancellations & Rescheduling
6.1 Customer Cancellations
You must provide a minimum of 96 hours’ notice to cancel or reschedule any session.
6.2 Cancellations made with less than 96 hours’ notice may be charged in full.
6.3 Refunds are not provided for missed sessions due to:

Late arrival
-
Incomplete paperwork
-
Lack of required medical clearance
-
Personal circumstances
-
Travel delays
-
Illness
6.4 Overland Underwater Cancellations
If we must cancel a session, you will be offered a rescheduled date at no additional cost.
We are not liable for any consequential losses (e.g., travel, accommodation, childcare).
7. Pool Sessions
7.1 All pool sessions are non‑refundable and non‑transferable under all circumstances.
7.2 Pool sessions must be pre‑booked.
7.3 A minimum of 96 hours’ notice is required to cancel or reschedule a pool session.
7.4 Late cancellations result in the loss of that session credit.
7.5 In‑water tuition is available at an additional cost.
8. Training, Performance & Certification
8.1 Certification is not guaranteed. It is earned by meeting all performance requirements set by the training agency.
8.2 Additional pool sessions or open water training days may be required if performance standards are not met. These may incur additional fees.
8.3 Training schedules must be agreed with Overland Underwater. Missed sessions may require additional training at additional cost.
8.4 We reserve the right to pause, modify, or stop training if safety, behaviour, performance, or environmental conditions require it.
9. Equipment
9.1 Equipment hire is included unless otherwise stated.
9.2 You are responsible for using equipment safely and responsibly.
9.3 Damage or loss caused by negligence will be charged at replacement cost.
10. Behaviour & Conduct
10.1 We operate a strict no‑touch, no‑take environmental policy.
10.2 Unsafe, negligent, disruptive, or inappropriate behaviour may result in removal from the session without refund.
10.3 Our instructors have full authority to make safety‑based decisions at any time.
11. Community Conduct (Online & In‑Person)
11.1 We maintain a welcoming, respectful community environment.
11.2 We do not tolerate:

Abuse
-
Racism
-
Harassment
-
Slander
-
Bullying
-
Inappropriate behaviour
11.3 We may remove individuals from our online or in‑person communities at our discretion.
12. Liability & Assumption of Risk
12.1 Scuba diving, snorkelling, and related activities involve inherent risks, including but not limited to:

Barotrauma
-
Decompression illness
-
Equipment malfunction
-
Environmental hazards
-
Injury from marine life
-
Slips, trips, and falls
12.2 By participating, you acknowledge and accept these risks.
12.3 You agree to:

Follow all instructions from Overland Underwater staff

Dive within your training and experience limits
-
Monitor your own physical and mental condition

Disclose accurate medical information
12.4 To the fullest extent permitted by law, Overland Underwater is not liable for:

Personal injury or loss arising from your failure to follow instructions

Loss or damage to personal property
-
Indirect or consequential losses
-
Costs incurred due to rescheduling or cancellation
12.5 Nothing in these Terms limits liability for death or personal injury caused by negligence.
